By accessing or using Applier (the "Service"), you ("User" or "you") agree to be bound by the following Terms of Use and Privacy Policy (collectively, the "Agreement"). If you do not agree with any portion of this Agreement, you must not use our Service.

1. DESCRIPTION OF THE SERVICE

1.1 What We Do

Applier automates the job application process by using AI Agents. You provide us with a link or select a position from one of the companies in our portal, and we apply for the job on your behalf.

1.2 No Guarantees

We make no guarantees regarding the correctness, relevance, or accuracy of any application submitted using our Service. You acknowledge that results may vary and that we are not responsible for verifying or guaranteeing the accuracy, completeness, or success of any job application.

2. DISCLAIMER OF LIABILITY

2.1 No Liability for AI Agents

You expressly acknowledge that the Service relies on AI Agents to automate job applications. We disclaim all liability and responsibility for any outcome arising from the use of these AI Agents, including but not limited to:

  • Incorrect or incomplete applications,
  • Applications sent to unintended positions or companies,
  • Misuse of names, qualifications, or personal details,
  • Failure to secure interviews or job offers, or
  • Any other errors or issues arising from automated processes.

2.2 Use at Your Own Risk

Your use of Applier is entirely at your own risk. We do not guarantee any specific results or employment prospects. The Service is provided "as is" and "as available," without warranty of any kind, whether express or implied.

2.3 Indemnification

To the fullest extent permissible by law, you agree to indemnify, defend, and hold us, our officers, directors, employees, contractors, agents, and affiliates harmless from and against any and all liabilities, damages, awards, settlements, losses, claims, actions, costs, and expenses (including reasonable attorneys' fees) in connection with any claim or action arising out of:
(a) your use of the Service,
(b) your breach of any of these Terms, or
(c) the inaccuracy or illegality of any information you provide.

2.4 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from or in any way connected to your use of Applier, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages. If, for any reason, we are found liable to you for any damages or losses arising from your use of Applier, our total liability shall not exceed the amount you have paid to us (if any) for the Service in the 12 months preceding the date of the claim.

2.5 No Warranties

We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

3. BILLING AND PAYMENT

3.1 Payment Information

We collect and use your credit card or other payment information solely for billing purposes. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for any fees due.

3.2 Third-Party Payment Processor

We may use third-party payment processors to facilitate payments. These third parties are responsible for processing and securing your payment information. We do not store your full payment card details on our servers.

3.3 Subscription or One-Time Fees

Depending on the plan or option you choose, you agree to pay any subscription or one-time fees as described during checkout. All fees are non-refundable unless otherwise stated.

3.4 Late Payments

We reserve the right to suspend or terminate access to our Service if any fees remain unpaid past their due date.

6. INTELLECTUAL PROPERTY

6.1 Ownership

All content, features, and functionality on Applier, including but not limited to text, graphics, logos, button icons, images, and software, are the exclusive property of Applier or its licensors.

6.2 Limited License

We grant you a personal, non-exclusive, non-transferable, revocable license to use our Service solely for your own personal or internal business use in accordance with this Agreement.

7. CHANGES TO THIS AGREEMENT

We may modify or update this Agreement at any time by posting the revised version on our website or otherwise notifying you. Your continued use of the Service after any changes become effective constitutes acceptance of the revised Agreement.

8. TERMINATION

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, if you violate this Agreement or for any other reason we deem appropriate.

9. GOVERNING LAW AND DISPUTE RESOLUTION

9.1 Governing Law

This Agreement and any non-contractual obligations arising out of or in connection with it shall be governed by and construed in accordance with the laws of the jurisdiction in which Applier is headquartered, without giving effect to conflicts of law principles.

9.2 Dispute Resolution

Any dispute arising out of or relating to this Agreement shall be resolved exclusively by the competent courts located in that jurisdiction. You consent to the personal jurisdiction of those courts.

9.3 No Class Actions

You agree to resolve any disputes with us on an individual basis and waive any right to participate in a class, consolidated, or representative action.

10. SEVERABILITY

If any provision of this Agreement is determined to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

11. ENTIRE AGREEMENT

This Agreement, together with any other legal notices or policies published by us, constitutes the entire agreement between you and Applier concerning the Service and supersedes all prior agreements and understandings, whether written or oral.

BY USING APPLIER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THIS AGREEMENT. YOU FURTHER AGREE THAT ANY LIABILITY FOR DAMAGES, LOSSES, CLAIMS, OR HARM OF ANY KIND ARISING OUT OF YOUR USE OF THE SERVICE IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW, AND THAT WE SHALL NOT BE HELD RESPONSIBLE OR LIABLE FOR ANY CLAIMS WHATSOEVER.

This Agreement is intended to be as comprehensive and protective as legally allowed, and any ambiguity shall be interpreted in favor of limiting Applier's liability to the fullest extent permissible by applicable law.
